Much hoorah is made about judicial candidates' "Judicial Philosophy." Some on the Far Right, (e.g. the Partisan Authors at IVoterGuide.com), have characterized me as a "Leaning Activist" Candidate. I take GREAT offense to this mis-characterization of who I am and what I stand for.  My judicial philosophy is SIMPLE. If elected, I will interpret BOTH the Montana and United States Constitutions according to THE TEXT of those documents and in a manner CONSISTENT with the ORIGINAL INTENT of our Founders in 1789 and, again, with respect to the  ORIGINAl INTENT of the 100  Citizen Authors of MONTANA's 1972 Constitution which was written and adopted, solely, by The PEOPLE of Montana  and NOT by corrupt, mealy mouthed  POLITICIANS. 


JUDICIAL ACTIVISM, has, to a great degree, "castrated" and dis-empowered both our State and Federal Courts.  Courts, as noted by Alexander Hamilton, and others, have neither the "Power of the Purse" nor "The Power of the Sword." The Judiciary's only REAL power is in determining what TRUTH is and, religiously, APPLYING FACTS TO THE LAW.  Without the respect of ALL, Montana Courts are destined to become just another bureaucracy that add nothing of substance to protecting and enforcing the CONSTITUTIONAL RIGHTS of ALL Montanans.

Douglas Wendell Marshall is deeply rooted in the American West, with five generations of his family having lived in the Montana and Wyoming  Territories prior to Statehood. 


For 137 years, his families have called the land along the Bozeman Trail  in Carbon, Park, and Gallatin counties, Montana, and in Park and Uinta Counties, Wyoming  "Home."  This rich family history reflects a strong connection to the region's land and Western heritage and underscores Marshall's profound ties to both the environment and community.

why I am running for Chief justice

In a nutshell, I am running for Chief Justice of Montana Supreme Court because I do not like what the politicians and those that control them have done to our State since I was a young boy growing up in Roberts, Montana where I was taught what our state and Federal Governments should look like. 


I was raised on the simple notion that both our State and Federal Constitutions required that ALL Government be "Of the People, 

By the People and For the People." 


After having lived in this great Land of Shining Mountains for 63 years now and practiced as a Montana trial lawyer for almost half of that time, I believe that neither our State nor our Federal governments have kept this simple promise to us: or, as we were taught, "we" "The People."
